IMPLEMENTASI “ASAS IJBARI” DALAM TRADISI WARIS DI KECAMATAN KEDUNGPRING KABUPATEN LAMONGAN

Inheritance tradition is a habit of inheritance distribution made by community groups, they create these habits based on needs. In Kedungpring District, Lamongan Regency, there is a tradition of inheritance distribution based on the habits that they have been doing from generation to generation. In the provisions of the Fiqh of Mawaris, namely the ijbari principle, it has provided a rule that the assets of someone who has died must be distributed directly to someone who is still alive and applies automatically or independently without the will of any party. In accordance with the context of the research above, the focus of this research is (1) What is the description between the implementation of the inheritance distribution tradition of the people of Kedungpring District, Lamongan Regency with the ijbari principle in the fiqh of Mawaris? (2) What conflicts arise from delays in the distribution of inheritance? This research is an empirical (field) research that uses a qualitative approach with a sociological perspective and the object is a tradition carried out by community groups. Data collection is done in the form of interviews with informants, observations and documentation. While the data analysis techniques carried out were data presentation, data reduction and leveraging, data analysis of the ijbari principle theories in Mawaris fiqh. The results of this study indicate that: (1) Delaying the distribution of inheritance after the heir dies is a habit that is carried out continuously by the people of Kedungpring, the reason used is because the inheritance of the heir is still used for the personal interests of the heir couple who incidentally he is also an expert inheritance. There are efforts from other heirs to hasten the distribution of inheritance so that the ownership of inheritance rights is clear, but the heirs consider that when he is still alive it is considered not appropriate to distribute the inheritance. (2) The influencing factors include. First, the lack of education and knowledge about inheritance. Second, after the heir dies, the heirs only focus on the joint prayer event for 40 days of death, 100 days of death and 1000 days of death, which causes costs to be incurred for funding the event and the costs include the share of the heirs. Third, the lack of harmonization in the family, which causes no specific communication to discuss the division of inheritance. Fourth, there are economic factors from the family where the inheritance is only small, so that one of the heirs feels that there is no need for division of inheritance. (3) As a result of delayed inheritance, several conflicts occurred, ranging from conflicts over the condition of the property left behind and conflicts between the heirs
